Türkiye ve Avrupa Birliği elektrik piyasalarında tüketici hakları ve emisyon tahsisi ile YEK-G belgesinin hukuki Niteliği
Özet
Türkiye ve AB gelecek beş ve on yıllık hedeflerinin yanı sıra 2050’deki hedeflerini de ortaya koymaktadır. Bu hedeflerde çevreyle dost, tüketici odaklı, herkesin sorumluluk üstlendiği, gelişmiş teknolojiye ve yenilenebilir kaynaklara dayalı bir toplum inşa etmek yer almaktadır. Bu çalışmada, elektrik piyasasının değişen yapısı tarihsel olarak inceledikten sonra bu yapının günümüzdeki durumu, piyasadaki roller ve sorumluluklar ile piyasa oyuncularının görevi ve tüketiciye sunulan sözleşmeler hukuki açıdan incelenmiştir. Bunun yanı sıra AB elektrik direktiflerinin hükümleri ve tüketici direktiflerinde yer alan elektrik piyasası ile ilgili kavram ve kurumlara yer verilmiştir. Elektrik piyasasında “tüketici” kavramı ve tüketicilerin hakları, elektrik piyasası mevzuatı ve TKHK kapsamında ele alınmıştır.
Türkiye’de Enerji Verimliliği Eylem Planı ve Yeşil Mutabakat Eylem Planı ile hedeflenen, sıfır karbon salınımını öngören ve tüketiciyi içine alan düzenlemelerin hayata geçirilmek istendiği görülmektedir. Bu kapsamda, Kyoto Protokolü ile ortaya çıkan karbon salınımını azaltan mekanizmalar ile emisyon ticaretine konu emisyon tahsislerinin (allowances) hukuki niteliği Türk ve AB mevzuatı kapsamında incelenmiştir. Ayrıca “Fit for 55” ile 2050’de karbon - nötr bir toplum yaratma fikriyle ortaya çıkan Sınırda Karbon Düzenleme Mekanizmasının (Carbon Border Adjustment Mechanism) etkisi ve Türkiye’nin Yeşil Enerji Mutabakatı ile ortaya konulan yenilenebilir enerji kaynaklarından üretilen elektriğin belgelenmesine ve ticaretine yer verilmiştir.
Türkiye and EU present their targets for 2050 alongside their targets for the next five and ten years. These goals include building an environmentally friendly and consumer-oriented society based on advanced technology and renewable resources, where everyone takes responsibility. In this study, after examining the changing structure of the electricity market historically, the current status of this structure, the roles and responsibilities in the market, the role of market players and the consumer's position in the market have been legally examined. On the other hand, provisions of the EU’s Electricity and Consumer Directives have been examined. The concept of "consumer" in the electricity market and the rights of consumers are discussed pursuant to the electricity market legislation and CPL (Consumer Protection Law).
In Türkiye, it is seen that the regulations, which are targeted by the Energy Efficiency Action Plan and the Green Deal Action Plan, foresee zero carbon emissions and cover the consumer have been intended to be implemented. In this context the mechanisms, which reduce carbon emissions, introduced by the Kyoto Protocol, the legal characteristics of allowances related to emissions trading have been examined within the scope of Turkish and EU legislation. In addition, "Fit for 55", the effect of the Carbon Border Adjustment Mechanism, which emerged with the idea of creating a carbon-neutral society in 2050, and the documentation and trade of electricity produced from renewable energy sources as set out in Türkiye's Green Deal, have also been included.
