dc.description.abstractReklâm anlayışı insanlar arasında değiş tokuşun yani modem tanımıyla alışverişin başlamasıyla doğmuştur. 20. yy’da büyük bir hızla gelişme kaydeden reklâmlar, radyo ve sonrasında televizyonların kullanılmaya ve yaygınlaşmaya başlamasıyla önemini arttırmıştır. Özünde mal ve hizmetlerin tanıtımına yönelik bir iletişim faaliyeti olan reklâm, günümüzde serbest piyasa ekonomilerinde üretici ile tüketici arasında köprü vazifesi gören, mal veya hizmetlerin tanıtımını sağlayan en önemli araçlardandır. Dolayısıyla bu önemli aracın kötüye kullanılması gerek tüketiciler gerek rakip firmalar açısından ağır sonuçlar doğurabileceğinden reklâmların denetimi zorunlu bir hal almıştır. Bu anlamda mevzuata aykırı reklâmlarla mücadele edilirken üç ayn yöntem uygulanmaktadır. Bunlar özel hukuk davaları, idari denetim ve özdenetimdir. Sağlık sektörü açısından AB mevzuatındaki özel düzenlemelere bakıldığında; İlaç reklâmlarının, özellikle Türkiye’nin AB sürecinde gerçekleştirdiği uyumlaştırma çalışmalarına kaynak teşkil ettiği gözlemlenmektedir. AB’de hastane ve doktor reklâmları ise, reklâm hukukunun genel esaslarına bağlı kalmak koşuluyla her devletin kendi iç hukuk düzenlemelerinin inisiyatifine bırakılmıştır. Ulusal mevzuat açısından; sağlık sektöründe yapılan reklâmların bir kısmının, toplum sağlığının taşıdığı önem dolayısıyla yasaklandığı, diğer kısmımnsa büyük ölçüde sınırlamalara tabi tutulduğu göze çarpmaktadır. Özel hastaneler ve diğer sağlık kuruluşları; sağlığı koruyucu ve geliştirici nitelikteki bilgilendirme ve tanıtımlar yapılabilir. Bilgilendirme ve tanıtım faaliyetleri kapsamında, yanıltıcı, abartılı, doğruluğu bilimsel olarak kanıtlanmamış bilgilere ve talep yaratmaya yönelik açıklamalara yer verilemez.Bu kuruluşlar, hizmet alanları ve sunacağı hizmetler ile açılış bilgileri ve benzeri konularda toplumu bilgilendirmek amacıyla sınırlı olmak kaydıyla tanıtım yapabilir ve ilân verebilirler. Ancak ağız ve diş sağlığı hizmeti ile ambulans hizmeti veren sağlık kuruluşlarının reklâm yapmaları yasaktır. Kuruluşların tabelaları, boyut ve içerik bakımından ilgili mevzuatlarında belirtilen esaslara uygun olmalıdır. Doktor reklâmlarına ilişkin mevzuatta; doktorların, aldatıcı ve haksız rekabete yol açıcı olmamak kaydıyla, çalışma yerleri ile uzmanlık alanlarını ve muayene gün ve saatlerini bildirir ilânlar yayımlamalarına izin verilmiş, ancak bunun dışındaki yazılı ve sözlü vasıtalarla reklâm yapmaları ve kanunun kabul ettiği çerçeve dışında tabela kullanmaları yasaklanmıştır. Zira veteriner, eczacı ve optisyenler açısından da mevzuat, benzer hükümler taşımaktadır. Sağlık sektöründe reklâm ilaç reklâmları açısından değerlendirilecek olursa, ilgili mevzuat uyannca reçeteyle satışına izin verilen ilaçların reklâmının yapılmasının yasak olduğu ortaya çıkmaktadır ki ulusal mevzuatın bu kapsamda birbiriyle uyum içinde olduğunu söylemek mümkündür. Şu kadar ki; söz konusu ilaçların tıbbi dergilerde tanıtımı yapılabilir. Ancak reçetesiz satışına izin verilen ilaçların tanıtımı konusunda mevzuat çelişkili ifadeler içermektedir. İlaç tanıtımına ilişkin ilk kanuni düzenleme “İspençiyari ve Tıbbi Müstahzarlar Kanunu” olup 1928 yılından beri yürürlüktedir ve İpi maddesiyle reçeteli-reçetesiz ilaç tanıtımına ilişkin sınırları çizmektedir. 23 Ekim 2003 tarihinde yürürlüğe giren “Beşeri Tıbbi Ürünlerin Tanıtım Faaliyetleri Hakkında Yönetmelik” ise AB müktesebatma paralel biçimde hazırlanmış olup konunun ayrıntılarını içermektedir. Ancak Danıştay tarafından Yönetmeliğin 4/d, 5/a, 7/1-6 ve 8. maddesinin yürütmesinin kanuna aykın olduğu gerekçesiyle durdurulmasına karar verilmiştir. Kanun, reçetesiz satılan ilaçların topluma tanıtımına, gazete ve tarifnamelerle sınırlı kalmak koşuluyla izin vermesine karşın; Yönetmelik AB müktesebatma uygun olarak, radyo ve televizyonlar da dâhil olmak üzere her türlü araçla reçetesiz ilaç tanıtımına izin vermektedir. Ancak normlar hiyerarşisi adına bugikı itibariyle kanunun ilgili hükmü geçerliliğini korumaktadır. Diğer taraftan, reçete ile satılan beşeri tıbbi ürünlerin sağlık mesleği mensuplarına tanıtımı, tıbbi satış temsilcilerinin hekim ve diş hekimine yaptıktan ziyaretler, numunelerin dağıtımı, sağlık mesleği mensuplarının katıldığı promosyon toplantılarının sponsorluğu, sağlık mesleği mensuplarının katıldığı bilimsel kongrelerin sponsorluğu ve özellikle söz konusu kişilerin bu kongrelerle ilgili seyahat ve konaklama masraflarının ödenmesi ilaç reklâmları açısından reklâm serbestisi sınırlan içerisindedir. Ancak, gerek reçeteyle gerek reçetesiz satışına izin verilen ilaç reklâmlannın aldatıcılık içermesi, örtülü (gizli) reklâmlannın yapılması ve reklâmlann mevzuata aykırı karşılaştırmalar içermesi genel ve özel düzenlemelerle yasaklanmıştır. The Concept of Commercials was bom with the exchange between people so with the modem description it began with the beginning of trade. The commercials recorded a great development in the 20th century and gained a bigger importance as the usage of radio started and was widespread the same after with the TV. Commercials which is an elementary communication action regarding the persentation of goods and services, in our present time is one of the most important tools that provides the demonstration of the goods and services and is a bridge in between the manufacturer and the consumer. Cunsequently the inspection of the commercial became obligatory as the use of these commercials may cause important results regarding both the consumers and the competing companies. In this meaning 3 different methods are being applied to struggle aganist the commercials which are in vialotion of the regulation. These are; private law suits, administravie inspection and self policing. When we take a look at the special regulations in the EC Legislation regarding tha Health Sector, it is observed that it is serving as a source especially to the harmonisation studies of Turkey to EC. The hospital and the doctor commercials are left upto the domestic regulations of each government with the condition that they do comply with the general aspects of the Commercial Law in EC. From the point of the National Regulation, it is recognised that some of the commercials in healt sector are forbidden and others are bounded to limits as the community health has a great importance. Private Hospitals and the other health establishments may do presentations and information demonstrations that would develop and protect health. Within the coverage of the Information and presentation actions, statements which include misdirecting, fulsome, scienctifically unproven knowledge and presentations which are to gain demand can not take place. These establishments may give information about their service fields and about service openings and may give adds and make presentations which are bound to limit in order to inform the community. The signboards of these establishments regarding the dimentions and the content must comply with the basis of the relative regulation In the legislation regarding the doctor advertisements, it is permitted that the doctors can broadcast or publish adds, stating their speciality field and Office days and hours which would also not be deceptive and would not couse unfair competition, but apart from this they are forbidden to publish written or spoken means of advertisements and are forbidden to use signboards which are not fitting witin the frame allowed by this taw. Forasmuch as the legislation contains similar arbitraments for the veterinaries, pharmacists and opticians. If the commercial in the health sector are determined regarding the medications, it appears that according to the legislation it is forbidden to publish commercials for the medications which are subject to sales only with doctors* prescription and it can be said that the domestic law is already harmonised within. It is just that the demonstration of the so said medication can be made in medicine journals and magazines. Provided that, the legislation contains conflicting statements regarding the advertisement of the medication which are permitted for sales. The legal regulation for the advertisement of medication is “spermaceti and medical preperations law” and is in force since 1928 and draws the borders of the advertisement for prescribed and unprescribed medication with the article 13. The regulation which became effective on 23rd October 2003 “Regulation of the Avertisement of Human Medical Products" was prepared paralel with the EC Acquis Communitaire and contains the details of the subject But The State Counsil has decided to stop the execution of this regulation with the legal ground that the execution of the articles 4/d,5/a,7/l-6 ve 8 of the regulation is not lawfull. Event though the Law permits the medication which are subject to sales without prescription to be presented to the community by newspaers and decsriptions with bounding limits, the regulations permits these medications to be advertised by any tools as radios and TV as it is complyin with the EC Acquis Communitaire. But in the name of norm hierarcy the relative desicion of the Law is still holding its validity. On the other hand, the demonstrations on these human medical products to the members of the health profession, visits of medical sales representatives to doctors offices and dentist offices, distribution of samples, the sponsorship of the demonstration meetings to which the members of health prosession attend, sponsorship of the congresses to those the members of health profession attend and especially paying the expenses of these congresses regarding the trip and accomodation of the said members is within the bounded limits of free actions regarding commercial medication advertisements. However; it is forbidden with general and special regulations that the advertisements of the both medication that are subject to sales even with or withour prescription may not contain deceptiveness, may not be advertised implicitly and may not contain comparisons which are forbidden according to the Advertisement Regulation.
