Takip talebinden önce borçludan ödeme ön talebinde bulunma zorunluluğu

Abstract

Takip talebi icra dairesine yazılı, sözlü veya elektronik ortamda yapılmaktadır. Alacaklı, ilâmlı icra yoluyla takibe başlamadan önce borcun ödenmesi için, bir banka hesap numarası da belirterek iadeli taahhütlü olarak borçlunun bilinen en son adresine borcunu ödemediği takdirde hakkında icra takibi yapılacağına ilişkin bilgileri içerir meşruhatlı ödeme bildiriminde bulunmak zorunda olmalıdır. Alacaklı, bu adrese bildirim yapılamaması veya bildirime rağmen yedi gün içerisinde borcun posta gideriyle birlikte ödenmemesi hâlinde icra takibini başlatabilmelidir. Ön talepte bulunulması sayesinde, ilâmlı takiplerde borçluya meşruhatlı bildirimde bulunmak zorunluluğu getirilerek, para alacakları icra takibine konulduğunda vekâlet ücreti ile diğer icra masraflarının asıl alacağın miktarını geçmesi ve icra dairelerinin küçük alacaklardan kaynaklanan iş sayılarındaki artış önlenebilir. Bu düzenleme ile ilâma bağlı alacaklardan iyi niyetli borçlunun haberdar olması sağlanarak borçların icra müdürlüğüne gelmeden önce tahsili sağlanabilir. Böylece yalnızca icra dairelerinin iş yükü azaltılmakla kalmayacak, borçlunun ödemek istediği borçlar hakkında yapılan para alacağına ilişkin ilâmlı icra takipleri nedeniyle icra masraf ve vekâlet ücreti ödenmesi nedeniyle maruz kaldığı mağduriyet de giderilebilecektir.

Sending Pre-Payment Claim Notice to the Debtor before Claim of Enforcement in the Enforcement of Judgments

Claims of enforcement shall be communicated to the enforcement office of relevance in writing or through any recognized electronic means of communication. In cases relying on a judgment, the creditor must give a comprehensive pre-payment claim notice, in such form and fashion to be determined by implementation regulations and incorporating all necessary details as to its claim, including the fact that enforcement proceedings would begin if the debtor fails to fulfill its obligations pending, to the last known address of the debtor via registered return mail with confirmation of receipt, also making notion of a bank account number for related funds to be paid, before the enforcement proceeding is put in process. The creditor should be able to initiated enforcement proceedings when no pre-payment claim notice reaches at such address as aforementioned or on failure of the debtor to pay up its debt in full, within seven days of it’s receipt of the creditor’s notice, together with respective postal mailing charges. With the arrangement of pre-payment claim notice in enforcement of money judgments, extra workload accumulations at enforcement offices, in connection with money claims, can be prevented while avoiding a rise in the attorney charges and other enforcement related costs, above and beyond the original balance of claims. As this arrangement provides for timely notification of good faith debtors of their debts, it aims at increasing the number of occasions where debts are collected without the debtor having to personally appear at the enforcement office, which, in fact, is seen to be a solution that not only helps reduction of the workloads of enforcement offices but also contributes to elimination of sufferings incurred for the side of the debtor, due to or in connection with its being forced to pay for enforcement costs and attorney charges in line with enforcement proceedings held against it, for enforcement of money judgments.
