Direnme hakkı ve pozitif hukuktaki değeri
Özet
İnsanlık tarihi boyunca insanların birbirleri üzerinde tahakkümü ve bu
tahakküme karşı direnç var olagelmiştir. Direncin iktidar ve yönetilen çelişkisi arasında
yaşanması kaçınılmaz bir durumdur. Bu durum Antik Yunandan günümüze iktidarın ve
iktidara itaatin sınırının tartışılmasına yol açmıştır. Bu tartışmadan çıkan pek çok fikir
arasından en aşırı olanı direnme hakkı olmuştur. Direnme hakkı; temel hakların başka
bir yol kalmadığında, güç kullanmak da dahil olmak üzere, her yolla savunabileceği
düşüncesini ifade etmektedir.
Orta çağın son döneminde merkezileşen krallıklarla kilise arasında oluşan ve
daha sonra mezhepler arasında devam eden iktidar mücadelelerinde direnme hakkı
fikirleri yaygınlaşmış, Aydınlanma çağıyla birlikte başlayan mutlak monarşilere karşı
yapılan devrimlerle zirveye çıkmıştır. II. Dünya Savaşı sonrası dönemde pek çok ülkede
yerini sağlamlaştıran sınırlı devlet ve hukuk devleti gibi kavramlarla artık direnme
hakkına gerek kalmadığı ve bundan böyle direnme hakkının şiddet hareketlerine bahane
olmaktan başka bir işe yaramayacağı düşüncesiyle tehlikeli görülmesine yol açmıştır.
Günümüzde hukuk devleti olduğunu iddia eden bir devletin temel hakları ihlal
etmeyeceği ya da ihlallerini çeşitli yollarla telafi edeceği düşüncesi ile direnme hakkının
nasıl bağdaşabileceği ve eğer bağdaşabilirse bunun sembolik mi, yoksa pratik olarak
anlamlı mı olacağı değerlendirilmelidir. Bu çalışmada direnme hakkı kavramı
incelendikten sonra, bu kavramın tarihsel gelişimine yer verilecek, mevcut örnekleriyle
güncel pozitif hukuktaki değeri sorgulanacaktır.
Throughout human history, people have dominated each other and there has been
resistance to this domination. Between ruler and ruled contradiction, experiencing some
sort of resistance is inevitable. This resistance has paved the way for the discussion of
the limit of power and obedience to authority, starting from Ancient Greece to the
present day. Of the many ideas that emerged from this discussion, the most extreme is
the right to resist. The right to resist argues that fundamental rights can be defended by
any means, including the use of force, if there is no other way.
In the last period of the Middle Ages, the ideas of the right to resist became
widespread during the power struggles between the centralized kingdoms and the
Church and then continued between the sects and came to its peak with the revolutions
against the absolute monarchies that began with the age of the Enlightenment. In the
post-World War II period, the prevalence of concepts like limited state and the rule of
law in many countries led to the notion that the right to resist was no longer necessary
since it became dangerous and an excuse for violent movements.
It should be evaluated how the right to resist is compatible with the idea that a
state claiming to be a state of law will not violate fundamental rights or will compensate
its violations in various ways and if it is compatible, it will be symbolic or practically
meaningful. In this study, after examining the concept of the right to resist, the historical
development of this concept will be included and its value in the current positive law
will be questioned.
