Medeni yargılama hukukunda hukuka aykırı şekilde elde edilen delillerin geçerliliği ve kullanılması
Özet
Bu çalışmada; hukuk devletinin çok tartışılan konulardan biri olan hukuka aykırı deliller, medeni yargılama hukuku kapsamında ele alınarak, öğretideki görüşler ve yargı uygulamaları anlatılmıştır.
Hâkim, dava dosyasına sunulan delilleri serbestçe değerlendirerek vicdani kanaatini oluşturur. Hâkimin maddi gerçeğe uygun ve adil bir karar verebilmesi için geçmişte yaşanmış bir olayın yargılama esnasında da gerçeğe uygun şekilde ortaya konulabilmesi gerekir. Ancak deliller elde edilirken ve değerlendirilirken devlet makamları ve taraflar hukuka uygun hareket etmek zorundadır. Aksi davranış, hukuk devleti ilkesine aykırılık oluşturacaktır.
Çalışmada; medeni yargılama hukukunda ispat hakkı ve sınırları ele alınmış, bu kapsamda hukuka aykırı yollardan elde edilen delillerin ve bu deliller vasıtasıyla elde edilen türev delillerin (zehirli ağacın meyvesi) yargılamaya etkileri, temel hak ve özgürlükler ile hukukun temel ilkelerini ne şekilde ihlal edebileceği açıklanmıştır. Ayrıca hukuka aykırı delillerin kullanılmasının yol açtığı sonuçlara karşı başvuru yolları da ele alınmıştır.
In this study; evidence against the law, which is one of the most controversial topics of the state of law is handled within the scope of civil jurisdiction law. Thus, the opinions and judicial practices in the doctrine are explained.
The judge freely evaluates the evidence presented in the case file and forms his conscientious opinion. In order for the judge to make a fair decision in accordance with the material truth, an event that happened in the past must be able to be truthfully revealed during the trial. However, state authorities and parties have to act in accordance with the law while obtaining and evaluating evidence. Otherwise, the behavior will be contrary to the rule of law.
The civil jurisdiction law, the right and limits of proof have been discussed in this study. Moreover, in this context, the effects of the evidence obtained through illegal means and derivative evidence (the fruit of the poisonous tree) on the judiciary, the fundamental rights and freedoms are elucidated as well as how these can violate the fundamental principles of the law. Furthermore, remedies against the consequences caused by the use of unlawful evidence are also discussed.
