İş kazası ve meslek hastalığı nedeniyle işveren ve üçüncü kişilerin sosyal güvenlik kurumu karşısındaki sorumluluğu
Özet
İş kazası ve meslek hastalığı işveren veya üçüncü kişilerin kanuni yükümlülüklerine
uymaması sonucu meydana geliyorsa ilgili kişilerin sorumluluğu doğacaktır. Yasada işveren
ve üçüncü kişilerin Sosyal Güvenlik Kurumuna karşı sorumluluğuna ilişkin düzenlemeler
öngörülmüştür.
İş kazası ve meslek hastalığı nedeniyle, işverenin sosyal güvenlik kurumu karşısındaki
sorumluluğu bazı koşulların varlığı halinde söz konusu olur. Bu koşullar ise, iş kazası ve
meslek hastalığı işverenin kastı ya da sigortalıların sağlığını koruma ve iş güvenliği
mevzuatına aykırı bir hareketi sonucu meydana gelmesi durumlarıdır. İşveren, iş sağlığı ve
güvenliği yönünden aklın, bilimin, tekniğin gerekli gördüğü her türlü önlem ve tedbiri
almakla yükümlüdür. Kanunda getirilen düzenlemeye göre işverenin sorumluluğunda
kaçınılmazlık ilkesinin dikkate alınır.
İş kazası ve meslek hastalığı halinde kurumun işverene rücu hakkı bulunmaktadır. Bu
durumun hukuki niteliği tartışmalı olmakla birlikte genel olarak işverenin rücu hakkının
kanuni halefiyet ilkesine dayandığı kabul edilmektedir. İş kazası ve meslek hastalığı
nedeniyle işveren, sigortalı ve hak sahiplerinin işverenden isteyebilecekleri tutarla sınırlı
olmak üzere Kuruma karşı sorumlu olur.
5510 S. Kanun kapsamında yükümlülüklerini yerine getirmeyen işveren Kurum
karşısında sorumlu olur. Yasa da işverenin yükümlülükleri belirtilmiştir. Özellikle
sigortalıları Kuruma bildirmeme, Sigortalıyı sağlık raporu ile çalıştırmamak, Sigortalıya ilk
sağlık yardımlarını yapmama ve son olarak iş kazası ve meslek hastalığının kanuni süre
içerisinde Kuruma bildirilmemesi durumlarında işverenin sorumluluğu söz konusu olur.
İşveren, Kurum tarafından sigortalı ve hak sahipleri için yapılmış her türlü masraf ile
bağlanan ve ileride bağlanması muhtemel gelirler için tanzim yükümlülüğündedir. İşverenin
yükümlülükleri sadece bunlarla sınırlı değildir. Kanun kapsamında Kuruma karşı diğer
yükümlülüklerini yerine getirmeyen işverenler hakkında idari para cezası uygulanacağı
düzenlenmiştir.
Üçüncü kişilerin Kuruma karşı sorumlu tutulabilmesi için iş kazası ve meslek
hastalığının bu üçüncü kişinin kusuru yüzünden gerçekleşmiş olması gerekir.
If work accidents and occupational diseases occur as a result of non-compliance with
the legal obligations of the employer or third parties, the responsibility of the relevant
persons will arise. The law envisages regulations regarding the liability of employers and
third parties to the Social Security Institution.
Due to work accidents and occupational diseases, the liability of the employer towards
the social security institution is in question in the presence of certain conditions. These
conditions are the cases where occupational accidents and occupational diseases occur as a
result of the employer's intention or an act contrary to the health protection and occupational
safety legislation of the insured. The employer is obliged to take all kinds of precautions and
measures deemed necessary by reason, science, and technique in terms of occupational
health and safety. According to the regulation introduced in the law, the principle of
inevitability is taken into account in the responsibility of the employer.
In case of work accidents and occupational disease, the institution has the right of
recourse to the employer. Although the legal nature of this situation is controversial, it is
generally accepted that the employer's right of recourse is based on the principle of legal
succession. Due to work accidents and occupational diseases, the employer shall be liable to
the Institution limited to the amount that the insured and beneficiaries may request from the
employer.
The employer who does not fulfill his obligations under the 5510 S. Law shall be liable
before the Institution. The employer's obligations are specified in the law. In particular, the
employer is responsible for not notifying the insured to the Institution, not employing the
insured with a medical report, not providing first health aid to the insured, and finally not
reporting the work accident and occupational disease to the Institution within the legal
period. The employer is obliged to arrange for all kinds of expenses incurred by the
Institution for the insured and beneficiaries, and for incomes that are likely to be incurred in
the future. The employer's obligations are not limited to these. Within the scope of the law,
it is regulated that an administrative fine will be imposed on employers who do not fulfill
their other obligations towards the Institution.
For third parties to be held accountable to the Institution, work accidents and
occupational diseases must have occurred due to the fault of this third party.
