Türk ceza muhakemesinde seri muhakeme usulü
Özet
Ceza muhakemesi hukukunda, gelişmekte olan dünya ve yaşam koşulları çerçevesinde ortaya çıkan yeni sorunların çözümünün sağlanması amacıyla çalışmalar yapılmaktadır. Ceza muhakemesinin ve ülkemizin yaşadığı en büyük sorunlardan biri yoğun dosya yükü altında çalışan adliyeler olduğu düşünüldüğünde bu durumun iyileştirilmesi açısından çalışmaların hız kazanması da olması gerekeni yansıtmaktadır. Bu kapsamda 7188 s. Kanun’la düzenlenmiş olan seri muhakemeyle basit yargılama usulleri yargılamanın iş yükünü azaltma amacıyla ortaya çıkmıştır.
Çalışmamız, hukuk sistemimize sonradan kazandırılan ceza muhakemesi usul yöntemlerinden seri muhakeme usulünün incelenmesi hakkındadır. Ayrıca söz konusu usul yöntemi hakkında; Türk hukuk sistemine girişi, mukayeseli hukuk bakımından tartışılması, diğer usul kurumları ile benzerlikleri ve ayrı düştükleri noktaları, Anayasal ilkelere uygunluğunun tartışılması ve uygulanması ile ilgili araştırmalar üzerinde durulmuştur.
Adaletin hızla yerini bulmasını hedefleyen yeni yargılama usullerinden seri muhakeme usulünün incelenmesinden oluşan çalışmada, adaletin hızlı olmasının her zaman doğru sonuçlar çıkarıp çıkarmayacağı noktasına dikkat çekilmiştir.
Various studies are currently carried out in the field of Code of Criminal Procedure with the objective to deliver solutions to new problems emerging within the framework of living conditions across the globe. Given that one of the major problems in our country within the field of Criminal Procedure is the intense caseload of courthouses, the evergrowing trend of the studies that are currently carried out for improving the current conditions, in fact, reflects what is expected to be. Within this context, serial judgement and simple adjudicatory procedures have been regulated pursuant to the Law no.: 7188 oriented at mitigating the workload of the courthouses.
Our study aims to carry out a deep analysis on the serial judgement procedure, as one of the criminal procedures, and which was brought in our legal system later on. Moreover, various researches have been carried out on the integration of this procedure into Turkish Law, along with the discussion of the same within the scope of comparative law, similarities with and points drifted away from other adjudicatory procedures, adaptation into the constitutional principles, and applicability of it, as well, within the scope of this study.
In this study, comprising of the detailed analysis of “serial judgement procedure” as one of the new adjudicatory procedures, which aims to serve justice within the shortest period of time possible, it is also underlined whether “speedy justice”, so to say, could result in the most accurate legal consequences, or not.
